Terms of Service
Last updated September 16, 2026
1. Agreement
These Terms of Service (“Terms”) form an agreement between you and Yardy (“Yardy”, “we”, “us”). By creating an account, browsing the site, or using any part of our services, you agree to these Terms. If you do not agree, do not use the services.
2. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract. You agree to provide accurate information, keep your login credentials secure, and are responsible for activity that occurs under your account. We may suspend or close accounts that violate these Terms.
3. What Yardy is
Yardy is a marketplace. Homeowners offer space on their own property, and businesses make offers for groups of properties in the same area. Yardy is not a party to the underlying arrangement between a homeowner and a business, and does not guarantee any particular result, level of interest, or amount of earnings. Any figures shown on the site, including address-based estimates, are estimates only.
4. Your responsibilities
- You confirm you have the right to make the property or materials you list or submit available, and that doing so does not breach any agreement or law that applies to you.
- You are responsible for obtaining any permissions required for your use of the services in your area.
- You agree not to misuse the services: no unlawful, deceptive, infringing, harassing, or harmful activity; no attempts to interfere with or gain unauthorized access to our systems; no scraping or automated collection without our written permission.
- You agree to communicate through the tools we provide and not to circumvent them to avoid fees.
- If you own a printed item placed through the services, you may not move it to, or reinstall it at, a different property outside Yardy's scheduling and matching system while it is tied to an active placement. Doing so may result in suspension of your account and forfeiture of remaining placement funds.
5. Content you submit
You keep ownership of the photos, videos, artwork, and other content you submit. You grant Yardy a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content as needed to operate, promote, and improve the services. You confirm you have the rights necessary to grant that license. We may remove content that we believe violates these Terms or applicable law.
6. How offers become live placements
- A business makes one offer covering several properties in the same area. Homeowners answer individually, and the placement only goes ahead once the minimum number of homeowners in that area have accepted.
- Until that point nothing is committed and no payment is taken. If the minimum is not reached, or the business does not give its final confirmation inside the stated window, the offer lapses.
- Placement lengths are offered in fixed numbers of days, shown to you before you accept.
- Homeowners must complete identity and property verification before receiving funds, and businesses must complete business verification before being charged.
7. Verification media and ongoing check-ins
Homeowners agree to submit the periodic photos or videos described in the product for the duration of a placement. Amounts for a period may be withheld, and ultimately returned to the business, where the required media is not provided within the stated window. Repeated failures may result in suspension.
8. Printed materials
Where the product states that Yardy arranges printing on a business's behalf, Yardy places that order with a third-party print vendor as a convenience. Once the order is placed, the printed item is the property of the business that paid for it. Print quality, production times, shipping, delays, damage, loss, returns, and replacements are matters between the business, the print vendor, and the carrier. Yardy is not responsible for any of them and makes no warranty about them, including for items that arrive damaged or incorrect, or that are lost in transit; reprints and reshipments are ordered at the business's cost. Where a tracking number is provided to us, we pass it on to the business.
After a placement ends, the business has 48 hours to arrange retrieval of its printed item or to confirm through the services that the item will be redeployed to another placement through Yardy. If the item has not been collected or redeployed within 7 days after the placement ends, disposal of the item and ownership rights in it pass to the homeowner, and Yardy's obligations with respect to that item end.
9. Payments and payouts
Payments and payouts are processed by third-party payment providers, and your use of those services is subject to their terms. Businesses authorize us and our providers to charge the payment method on file for amounts owed once a placement is confirmed. Homeowners agree to connect a payout account and supply the information required to receive funds; amounts are paid on the recurring schedule shown in the product, as each period's requirements are met. Fees applicable to your account are disclosed in the product before you commit. Except where required by law or expressly stated, amounts paid are non-refundable. Where a placement does not go live within the stated window after payment, the product describes how amounts are apportioned and returned.
10. Referrals, testimonials and promotions
Where we offer a referral or testimonial reward, the amount and conditions are stated at the time. Rewards are discretionary, may be changed or withdrawn, and may be withheld where we believe an account has been used abusively or the underlying activity is reversed. If you provide a testimonial, you grant us the rights described in the release you sign at that time.
11. Taxes
You are responsible for determining and paying any taxes that apply to amounts you receive or pay through the services. We may collect tax information and issue tax forms where required.
12. Third-party services
The services integrate third-party tools, including mapping, payment, and email providers. We are not responsible for third-party services and do not control their content or availability.
13. Suspension and termination
You may stop using the services at any time. We may suspend or terminate access, with or without notice, if we believe you have violated these Terms, created risk or legal exposure, or if we discontinue the services. Obligations that accrued before termination survive it.
14. Disclaimers
The services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, secure, or error-free.
15. Limitation of liability
To the maximum extent permitted by law, Yardy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the services will not exceed the greater of the amounts you paid or received through the services in the twelve months before the claim, or one hundred US dollars.
16. Indemnity
You agree to defend, indemnify, and hold harmless Yardy and its officers, employees, and agents from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the services, your content, or your breach of these Terms.
17. Changes
We may update these Terms. If a change is material, we will provide notice through the services or by email. Continued use after the effective date means you accept the updated Terms.
18. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws rules. You and Yardy agree to the exclusive jurisdiction of the state and federal courts located in Florida for any dispute that is not otherwise resolved, except where applicable law grants you the right to bring a claim elsewhere.
